On Monday, 14 October, Benjamin Lam and Raphael Leung presented an informative and enlightening CPD seminar at Ince & Co before an audience of about 20 solicitors.
The seminar was entitled Interim Measures via Hong Kong Court In Aid of Arbitration, and Arbitration Funding Options in Hong Kong.
Ben’s presentation focused on interim applications to the Hong Kong courts in aid of Hong Kong and foreign arbitration. Ben provided an overview of the statutory framework and some of the more common interim measures, providing practical tips and highlighting common pitfalls.
Raphael’s talk focused on arbitration funding options, focusing on traditional fee arrangements, third party funding and the more recently implemented outcome related fee structures, including conditional fee arrangements, damages-based arrangements and hybrid models. Finally, Raphael elucidated on the need to keep the client’s preferences front of mind when deciding on the type of outcome related fee structures.
The speakers were able to break bread over a delicious lunch which preceded the seminar. Informal questions led to an interactive discussion once the presentation had wrapped up.
