In DCCJ 4209/2018 Re: Shum Kun Nam Tso, Parkside’s Lareina Chan successfully resisted the Defendant’s striking out application in relation to New Territories “Tso” property, which was dismissed with costs to be paid forthwith. The Defendant sought to strike out the entire claim on the basis of an alleged lack of unanimity of consent of the registered managers of the Tso in deciding to commence the action against the Defendant, who effectively sought exclusive possession of the Tso property to the exclusion of all other members. It was argued that the application was misconceived and misplaced, and Master Andrea Yu found that the Defendant failed on all limbs of his application.
