On 1 December 2018, members of Parkside Chambers and other members of the Bar were invited to hold a seminar on “Matrimonial Law in Hong Kong” at Yucca Hotel, Jiangmen.
The seminar was organised and hosted by the Guangdong Lawyers’ Association and the Jiangmen Lawyers’ Association. The audience mainly comprised legal practitioners from different cities of the Guangdong Province, including Jiangmen, Shenzhen, Zhuhai, Huizhou, Dongguan, Foshan, and Zhongshan etc.
Four presentations were delivered after a succinct opening speech was given by Paul Lam SC.
Frederick Chan, together with Jeremy Yau and Lily Yu delivered a presentation entitled “The Divorce Jurisdictions of the Mainland and Hong Kong”. Frederick gave a broad overview of the topic and Lily took the audience through a series of cases illustrating the jurisdictional challenges faced by the Hong Kong Court. Lastly, Jeremy discussed the issue of enforceability of Mainland judgments in Hong Kong.
Vincent Lung and Selina Kung delivered a presentation entitled “Jurisdiction of the Hong Kong Court in Granting Financial Relief in Connection with Marriage”. Vincent took the audience through the legal position of Hong Kong in respect of financial provision. After which Selina went through the topic of enforceability of pre-nuptial agreement.
Martin Wong delivered a presentation entitled “International Aspects of the Law Relating to Children”. He took the audience through the wardship jurisdiction of the Hong Kong Court and the legal regime of removal of children from Hong Kong.
Osmond Lam together with Rachel Siu, and Katy Chung delivered a presentation entitled “Enforcement of Judgment”. They took the audience through various enforcement remedies which are at the Hong Kong Court’s disposal including Judgment summons, Writ of fieri facias, and Order of Committal.
The day was concluded by a forum also held at Yucca Hotel, Jiangmen. Paul Lam SC and other members of the Bar had in-depth discussions with the representatives of the Guangdong Lawyers’ Association and the Jiangmen Lawyers’ Association, including Chan Fang, the Vice President of the Guangdong Lawyers’ Association and Li Jingran, the President of the Jiangmen Lawyers’ Association.
