On 20 December 2018, Paul Lam SC, together with Martin Wong, Jeffrey Li and Astina Au delivered a seminar on Mareva Injunctions in aid of Mainland court and arbitral proceedings.
The seminar was hosted by China Commercial Law Firm, Qianhai Belt and Road Legal Services Federation and Shenzhen University Center for Basic Laws of Hong Kong and Macau Special Administrative Regions. The audience mainly comprised Mainland legal practitioners who are interested in and handling cases and arbitrations involving Hong Kong parties or assets.
Paul gave an overview of the key concepts and procedures of Mareva Injunction applications in Hong Kong court and highlighted major differences between section 21M of the High Court Ordinance and the Mainland “asset preservation” procedures. Jeffrey and Astina took the audience through 2 case studies in that connection and Martin gave a brief overview of the relevant sections concerning interim measures under the Arbitration Ordinance.
