Parkside’s  Toby Brown delivered an engaging and incisive presentation before 30 lawyers from Tanner De Witt on 30 July.

A delicious dumpling lunch was served before Toby guided the audience through Asset Tracing and various tactics used in crypto fraud.

Fraud:- Toby discussed the high volume hit and miss strategy deployed by predators to transfer money from a victim’s business account to their personal account.

Pleadings: – He also reviewed the challenges of managing multiple layers in fraud cases and the importance of particularlising allegations in pleading fraud cases. He addressed various issues that could arise in the context of pleadings and how to overcome certain presumptions.

Injunctions:- Toby examined the legal implications of freezing bank accounts in HK and the pain points associated with suing someone for fraud in a jurisdiction where the defendant’s location was unknown. He then highlighted the unique aspects of various cases he had helmed to demonstrate real life examples and draw analogies.

Q&A Session: – A fascinating round of questions from the audience led to collective speculation and conversation about the future and possible reform around service of legal documents as well as some challenges that lay ahead.
