On Wednesday, 20th May, Parkside’s Alice Lau and Jacquelyn Ng presented a captivating CPD seminar at Dentons and discussed recent estate disputes in Hong Kong, focusing on control, assets, and protection. They highlighted the importance of determining control over bodies and funeral arrangements, and the concept of “what’s in the pot,” addressing disputes over lifetime transfers and advancements.
The presentation also touched on recent developments in relation to the Mocambique rule under which the HK court will decline jurisdiction over disputes of title and interest in overseas immoveables, unless an exception applies. This is a reminder that in estate planning special regard should be had to foreign properties. The conversation also covered Enduring Power of Attorney (EPOA), its statutory framework, and the court’s supervision over attorneys. The importance of catering for minor children and dependents was emphasized through a brief discussion of deeds of guardianship, setting up trusts for minor children and considering the implications of the Inheritance (Provision for Family and Dependents) Ordinance (Cap 481).
It was an erudite session that shed light on numerous issues to be considered for comprehensive estate planning.
