Ben provided valuable insights on interim measures granted by the Hong Kong courts in support of arbitration, reviewing some of the common interim reliefs sought under Section 45 and 60 of the Arbitration Ordinance. His discussion underscored the strategic use of these temporary measures in protecting parties’ interests before and during the arbitral proceedings.
Raphael explored the evolving landscape of arbitration funding in Hong Kong, focusing on the Outcome Related Fee Structures for Arbitration (ORFSA). He unpacked the key features of conditional fee arrangements, damages-based agreements, and hybrid models—emphasising the need for clarity around “successful outcomes” and compliance with statutory and professional conduct requirements.
The session was warmly received and wrapped up with a lively Q&A exploring how these legal tools are being used in practice.
