On Wednesday, 30th September, Parkside’s Nigel Kat SC, Deanna Law and Leticia Tang delivered an insightful and astute CPD presentation at Clyde & Co, with able assistance from our newest tenant, Alex CH Chan. About 20 solicitors attended the presentation to hear about Professional Negligence in a presentation entitled “From Claim to Complaint: Defending Solicitors and Doctors against Civil and Regulatory Risk.” The seminar provided a detailed overview of professional negligence focusing on the scope of duty for solicitors and the principles of limitation.
Nigel discussed the evolving landscape of solicitor liability, emphasising that the scope of duty is increasingly defined by the purpose of the retainer. He also delved into four core questions, supported by relevant and recent case law, clarifying that the scope of duty was derived from the purpose of the duty.
Leticia addressed the complexities of limitation in negligence claims where losses often surfaced years after the initial advice was given. She discussed the statutory framework and took the audience through helpful case analysis.
Deanna concluded with a thoughtful and thorough summary of the regulatory processes for solicitor misconduct, comparing them to medical negligence frameworks. She also outlined compliance issues and liability risks. She addressed concerns regarding professional indemnity and liability gaps between different legal professionals.
There were illuminating and incisive questions from the audience, and the session wrapped up with some banter and helpful takeaways.
Thank you to Clyde & Co for hosting and providing a tasty lunch.
