Clients prefer ADR and arbitration for its private nature, cost savings, and efficient resolution of conflicts. Hong Kong is uniquely positioned as a global hub for arbitration, bolstered by its strategic location and a robust legal framework that supports these processes.
In a landmark move for the ADR and arbitration fields, Hong Kong introduced the Arbitration and Mediation Legislation (Third Party Funding) (Amendment) Ordinance in 2017, revolutionising the approach to third-party funding in arbitration and mediation. This legislation ensures that such funding aligns with established legal principles while incorporating necessary protections.
Our members have a wealth of experience in both representing clients and acting as arbitrators in a wide array of arbitration cases, whether they are under the auspices of international bodies—such as the HKIAC, CIETAC, SIAC, LMAA, ICC, and UNCITRAL—or within domestic parameters.
