Overview

Nigel Kat SC has a broad civil litigation and advisory practice, with an emphasis on public law and commercial law. In 2024, both Chambers & Partners and the Legal 500 rank him in Band 1 for Administrative & Public Law and a Leading Silk for Commercial Dispute Resolution. He also appears as a Leading Silk for Labour and Employment in the Legal 500 and Doyle’s, and as a Leading Silk for Commercial Mediation in Who’s Who Legal/Lexology 2024 .

He appears regularly in the Court of Final Appeal but is also in demand for trials, where he is reported to be a “good strategist and advocate” with “well-developed instincts and an eye for what the judge expects”, ‘better than most Hong Kong barristers at being a team player‘.

Nigel’s broad practice across a range of High Court commercial litigation and international arbitration includes banking, insurance, and international trade contracts. His arguments on limitation for bankers and their Quistclose liability in PT Tugu v Citibank [2022] HKCA 510, [2018] 5 HKLRD 277 were recently upheld by the CFA on appeal. In the financial services field, he has advised and conducted cases and arbitrations concerning high value shareholder disputes, share placement, and regulatory issues. Unusually, he established economic (commercial) duress by a major international investment bank against a smaller counterparty in connection with the placement of listed shares in a falling market. He has dealt capably with contested liquidations and directors’ liability, including in the protracted, unwieldy and complex Akai litigation that followed its collapse.

Nigel has been an arbitrator for many years, sitting as sole arbitrator and chairman, as well as a panel member. He is on the panel of arbitrators of the HKIAC, CI Arb, ICC HK, HKInstArb, APRAG and the Hong Kong Bar. As counsel, he has appeared and conducted international commercial arbitrations held under a variety of rules, including ad hoc, UNCITRAL, ICC and HKIAC. His admission to the New York Bar in 1984 has enabled him to take on arbitration governed by New York law, a rarity and a distinct differentiator of Nigel’s practice, particularly in the HK market. Recent party-appointed arbitrator appointments include a significant and nuanced US$540 million claim by a PRC investor against a U.S. second-tier financier, and he has succeeded in obtaining favourable awards with other multimillion US$ claims by venture capital investors and a manufacturer against PRC companies and individuals.

In his public and administrative law practice, Nigel has an enviable breadth of experience and has achieved considerable success over the last 30 years in conventional, administrative law judicial review and in constitutional matters. His substantial and diverse body of work in these areas speaks to his expertise and proficiency which has led to deeper client relationships.

He has conducted a number of successful planning and environmental JR challenges for residential developers and owners - see, eg The Methodist Church, Hong Kong v The Town Planning Board [2021] HKCFI 1060 - and for the Country Parks, reasserting the Town Planning Board’s Tameside duties along the way, eg Chan Ka Lam v The Country and Marine Parks Authority (2020) 23 HKCFAR 414.

On the civil and human rights front, in 2023, in a unique and innovative case, he persuaded the Court to declare a same-sex egg donor married overseas to the birth mother to be the child’s “parent at common law”: NF v R [2023] 5 HKLRD 58. This was a watershed decision. In 2018 and 2019, he successfully conducted the landmark same-sex marriage employment and taxation rights case: Leung Chun Kwong Angus v. Secretary for the Civil Service [2017] 2 HKPRD 1132, [2018] 3HKLRD 84, (2019) 22 HKCFAR 127, (2019) HKCFAR 282. This case was heralded as an “important victory and a huge step forward for equality” in the city.

He recently advised and represented the HK Journalists Association, persuading the Government to incorporate a reporting exception to the blanket injunction sought against the song “Glory to Hong Kong”.

In Designing Hong Kong Limited v The Town Planning Board (2018) 21 HKCFAR 237, he established the Protective Costs Orders regime in Hong Kong.

Nigel’s labour and employment practice has more recently focussed on advice re blue-chip company terminations and re-employment following the upheavals engendered by COVID 19.
In the specialist field of rating, valuation and compensation, Nigel has advised the major developers and utilities including CLP, and appeared in the Lands Tribunal, Court of Appeal and the Court of Final Appeal. His expertise in business valuation, including by a variety of equity and DCF methods, was developed in those cases and is now principally deployed in shareholder disputes.

He has recently argued a white-collar crime case testing the limits of restraint orders under the Organized And Serious Crimes Ordinance (OSCO) up to and in the Court of Final Appeal: Tam Kit I v HKSAR (2023) 26 HKCFAR 63.
