Overview

Prior to being called to the Bar in Hong Kong in 1991, Osmond was called to the English Bar in 1988, did a master degree in University of London, and served under the Crown Prosecution Service as a prosecutor for almost 2 years in the Inner London area.

Osmond accrued an impressive 30 years of experience in litigating and advising on criminal matters since 1992, earning him the distinction of being one of the most dedicated and seasoned criminal barristers in Hong Kong.

Osmond's trial advocacy is of the highest calibre in Hong Kong, particularly the instinctive style of his cross-examination which allows him to expose weaknesses in the evidence of a witness. In addition, Osmond's deep understanding and knowledge of the law go hand in hand with his strong common sense and "human touch", in other words, Osmond excels in understanding a case from the perspective of the lay client demonstrating a strong sense of empathy, while being able to discern the weaknesses of the prosecution's case.

In addition, Osmond is extremely meticulous and he brings the same level of dedication to all of his work, which includes some of the most complicated and high-profile cases (especially white-collar/ICAC related cases).

Selected Cases
  • Wong Ka Yan Patrick v Cheung Ka Yu Nicole formerly known as Cheung Lee Hung [2023] HKCA 1310; [2021] HKCFI 3765 – Represented the Plaintiff in the trial and its appeal against the judgment concerning the beneficial ownership of a real property. The Court reaffirmed the legal principles the appellate court’s interference with the trial judge’s finding of facts.
  • Rai Jagindra & Ors v Personal Representative of the Estate of Chow Sun, Deceased [2023] HKDC 1220 – Represented the Plaintiffs successfully claimed adverse possession against the subject real property by way of application of default judgment. The Court reaffirmed that, in application of default judgment, the general rule is that the Court cannot receive any evidence and must consider the application based on the pleadings; and while the Court would not grant declaration in default judgment application generally, adverse possession cases could be an exceptional situation where appropriate to do so.
  • Fung Yuk Luen v Wong Fung Lan & Ors [2023] HKCA 641; [2023] HKCA 184; [2022] 1 HKLRD 247; [2021] HKDC 487 – Appeared on behalf of the Defendants from trial up to Defendants’ appeal against the judgment concerning a claim of adverse possession. At the appeal against the judgment handed down by the Court of Appeal, the Defendants relied on grounds that the question involved in the appeal is of its great general or public importance and/or otherwise.

  •  郭(前稱郭) v 孫(又名孫) and Anor [2022] HKFC 87 – Represented the Defendant father in resisting the enforcement of charging order arising out from a claim of maintenance brought by the Plaintiff mother; and in counterclaiming against the Plaintiff for the declaration of trust of the property in question.

In deciding if a piece of new evidence can be adduced, the Court further considered the significance of the new evidence to support the ground of appeal and whether the Respondent would be significantly prejudiced.
