Yesterday, Parkside’s Toby Brown and Joshua Wang delivered an online CPD presentation in front of about 20 solicitors from Lewis Silkin.
The title of the talk was “No Way Out? Contractual Escape Routes and the Strategic Use of Injunctions.”
The presentation detailed the evolution of sophisticated fraud techniques and Toby and Joshua provided guidance on managing injunction applications and avoiding litigation pitfalls.
Toby discussed how fraudsters had transitioned from simple email scams to highly advanced methods. He also covered critical procedural elements in the context of Mareva injunctions and legal strategy. In terms of legal defences, he identified key precedents for resisting or challenging injunctions.
Joshua outlined several ways to challenge or escape a contract and discussed vitiating factors in contracts. He examined promissory estoppel applications, collateral contracts and convention, contract modification and sham terms.
The session provided a practical look at some complex issues arising in fraud, injunctions and contractual disputes, with the discussion concluding with an interesting question from the audience about Mareva injunctions and ongoing police investigations.
