Parkside’s Wayne Walsh SC and Fergus Tam presented a CPD seminar in front of Hogan Lovells entitled “When is Money Laundering Not Money Laundering – A Closer Look at Tax Evasion” on Thursday, 29th May.
In an engaging Zoom presentation which brought together close to 50 attendees from a host of Hogan Lovells’ regional offices including Beijing, Shanghai, Singapore, Jakarta, Tokyo, Ho Chi Minh and Hanoi, Wayne and Fergus welcomed the opportunity to discuss the intersection of tax evasion and money laundering using a HK case involving a Korean conglomerate and its employee.
They analysed the “clean money” argument and its implications in detail. They also talked about the “benefit” requirement for confiscation orders in money laundering cases and the relevant case law. They followed up with technical grounds for discharging restraint orders and assessed the impact on future cases.
The session wrapped up with a short discussion on double jeopardy and an interesting Q&A session.
